Students

Studying in Spain is a window to the working world since foreign students in Spain have the opportunity to do internships in large companies. In this way, you will be able to gain experience and make your professional profile known, increasing your chances of being hired and changing your status from student to resident.
Foreign students in Spain can apply for a visa both in their country of origin and in Spain and extend their visa as they extend their studies. Likewise, and during the time of their studies, they will have the opportunity to work up to a maximum of 30 hours either as salaried employees or self-employed. 

At the end of their studies and in the periods of renewal of the authorization of stay for studies, foreign students may apply for a change of status to a residence authorization to seek employment, a residence authorization for an internship contract or agreement, or a residence and work authorization.

Non-profit residency

Non-profit residency is the one that allows the non-EU foreigner to reside with his family in Spain without working or carrying out lucrative activities. 

This residence authorization is intended for persons who have a certain level of income or savings sufficient to support themselves without actively seeking employment, have no criminal record and have private health insurance. This residence is valid for 1 year, renewable, and will allow you to apply for Spanish nationality by residence.

 

Residency by settlement

Currently, there are 4 different types of arraigo and each one with its specific requirements: family arraigo; social arraigo; labor arraigo and arraigo for training.

Taking into account the particular situation of each one, the individual will be able to apply for a certain type of arraigo and thus be able to regularize his/her situation in Spain. It is one of the best alternatives to be able to live and work legally for those non-EU foreigners who have been in an irregular situation in Spain for a certain period of time. The terms of this previous stay vary from 2 to 3 years with the exception of the “arraigo familiar”, for which this time of previous stay is not required, since it contemplates exclusively the direct relatives of Spanish citizens.

Community citizens and their family members

This section contemplates the conditions for the exercise of the rights of entry and exit, free circulation, stay, residence and work in Spain by citizens of other Member States of the European Union, those of the Agreement on the European Economic Area (Iceland, Liechtenstein and Norway) and Switzerland, as well as their family members.

Community citizens who are going to reside in Spanish territory for a period of more than three months are obliged to request their registration in the Central Registry of Foreigners, and they will be issued a registration certificate. This certificate will allow them to work as employees or to start a business in Spain. 

For their part, non-EU family members of a Spanish citizen or of another EU Member State must apply for a residence card for family members of EU citizens. This card will allow them to work as employees or self-employed for a renewable period of 5 years and will allow them to apply for Spanish nationality by residence.

 

Mixed marriages

Marriages between persons of different nationalities or celebrated abroad by Spanish nationals are completely valid. Likewise, foreigners residing in Spain also have the possibility of getting married in the country. However, they raise special questions of capacity, consent and form that do not occur in marriages that do not have this foreign element.

 

International Mobility

The approval in 2013 of the so-called Entrepreneurs Law or Law 14/2013, brought about important developments in the way in which foreign citizens could achieve residency in Spain through different types of visa or residency: investors, entrepreneurs, highly qualified personnel, researchers, inter-company transfer workers, and digital nomads.

All these residences have in common that they are granted with a validity of 2 to 3 years, can be extended to family members immediately and allow applying for Spanish nationality by residence. 

Residence for investors: of real estate, investment funds or public debt. 

Residence for highly qualified professionals: allows the foreign worker to perform a work activity that requires a higher education qualification or a minimum of three years of professional experience in the sector.

Residence for entrepreneurs: any foreigner who wishes to develop an entrepreneurial and business activity, of an innovative nature and that has special economic interest in Spain, may opt for this type of residence permit. 

Residence for researchers: who wish to carry out training, research, development and innovation activities in public or private entities established in Spain, and who have an offer to carry out such activity.

Residence for intra-company transfer: for foreigners who temporarily move to Spain within the framework of an employment, professional or training relationship, from a foreign company to a company or group of companies established in Spain.

Residence as an international teleworker or digital nomad: allows foreigners who are not citizens of the European Union to live and carry out a work or professional activity at a distance for companies located outside the national territory through computer, telecommunication and telematic systems and means.

 

Nationality

Spanish nationality is the legal status held by those born in Spanish territory and those foreigners who meet the necessary requirements. 

You can open your Spanish nationality file by different ways, depending on your personal situation: Nationality by residence, by option, with value of simple presumption, by Letter of Nature and the Nationality by the Law of Democratic Memory or Law of Grandchildren.
